Legal
Terms of Service
These terms apply when you use our website, owlattic.com, buy a license from us or write to us. They are an agreement between you and OwlAttic, LLC (“OwlAttic”, “we”, “us”), a limited liability company registered in Delaware, United States.
Three other documents go with them:
- the Software License Agreement, which covers how you may use our apps;
- the Refund Policy, which covers refunds;
- the Privacy Policy, which explains how we handle personal information.
By using the website or buying a license, you agree to these terms. If you accept them on behalf of a company, you confirm that you may do so, and “you” means that company.
Our products
OwlAttic Terminal is available for Windows. Features that the website marks as planned, and the plans and prices of editions that are not on sale yet, describe our plans and may change.
OwlAttic Terminal comes in two editions:
- Free: the app with its core features, at no cost and for any purpose, including work.
- Pro: a license, bought with a single payment, that unlocks the paid features. It is not on sale yet.
We do not offer subscriptions or online services yet. If we add them, for example cloud sync, they will come with their own terms, which we will show you before you sign up.
Buying a license
- Prices are shown in US dollars. Sales tax, VAT or a similar tax may be added at checkout, depending on where you live.
- Payment is handled by Stripe. We never see or store your full card details.
- Delivery: after you pay, we send your license key to the email address you gave at checkout. You need it to activate the app; keep it safe. If it does not arrive, write to us.
- Who may buy: you must be at least 18, or older if the law where you live sets a higher age of majority.
- We may refuse or cancel an order, for example if a price on the website was clearly wrong or the order looks fraudulent. If we cancel an order you have paid for, we refund it in full.
Refunds and payment disputes
You can get a full refund within 30 days of purchase, for any reason, once for each product. The Refund Policy explains how to ask for one.
If something is wrong with a charge, please write to us first; we will put it right quickly. If you dispute a payment with your bank or card issuer instead, we may suspend the license while the dispute is open, and if the payment is reversed, the license ends.
Emails from us
We send you emails about your purchases and licenses, such as receipts, license keys and notice of important changes to these terms. You agree to receive them by email. We send other emails, such as news about our products, only if you asked for them.
Using the website
You may read the website, link to it and share its pages. Please do not:
- use the website or our email address to break the law or to harm others;
- try to reach parts of our systems that are not meant for you, or overload or disrupt them;
- copy large parts of the website to publish them as your own.
Our content and names
The website and our apps, including their design, text, images and code, belong to OwlAttic or to those who licensed them to us, and are protected by copyright and other laws. “OwlAttic”, “OwlAttic Terminal”, “OwlAttic Agent” and our logos are our trademarks. Do not use them in a way that suggests we made, sponsor or endorse something we did not.
Open-source components in our apps are licensed under their own terms, as the Software License Agreement explains.
Your feedback
We welcome ideas and suggestions. If you send us some, we may use them to improve our products, without owing you anything for it. We will not name you without asking.
Other websites
Our website links to other sites, such as Cloudflare’s and Stripe’s. We are not responsible for their content or how they handle your information.
No warranty
We work to keep the website accurate and available, but we provide it “as is”. To the extent the law allows, we do not promise that it will always be available, free of errors or up to date. The warranty for our software is in the Software License Agreement.
Limitation of liability
To the extent the law allows:
- we are not liable for indirect, incidental, special or consequential losses, such as lost profits, lost data or business interruption;
- our total liability to you for all claims about these terms, the website or your purchases is limited to the amount you paid us in the 12 months before the claim, or US$50 if you paid us nothing in that period.
Nothing in these terms limits liability that the law does not allow us to limit, such as liability for fraud, or for death or personal injury caused by negligence.
If you are a consumer
If you live in the European Union, the United Kingdom or another country with consumer protection laws, you keep every right those laws give you. Nothing in these terms takes those rights away; where these terms say “to the extent the law allows”, this is what we mean.
Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Disputes will be decided by the state or federal courts located in Delaware, unless the law of the country where you live as a consumer lets you bring the case in your local courts.
Before going to court, please write to us. Most problems can be solved by email.
General
- These terms, together with the documents they refer to, are the whole agreement between you and us about their subject.
- If any part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- We may transfer these terms to a company that takes over our business or the product you bought, and we will tell you if we do; your rights will not be reduced. You may not transfer your rights under these terms without our agreement.
- We are not responsible for delays or failures caused by events beyond our reasonable control.
- These terms are written in English. Translations are provided for convenience; if a translation differs from the English version, the English version applies, to the extent the law allows.
Changes to these terms
We may update these terms, for example when we add products or when the law changes. We will publish the new version here with a new date. A change does not apply to a purchase made before it, unless you agree. If you keep using the website after a change, the new terms apply to that use.
